1. Acceptance of Terms

By accessing or using SnapAU.ai ("the Service") at snapau.com.au, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

SnapAU.ai provides AI-powered image generation services including:

• Pro Headshots: Professional headshot generation from a single reference photo using our AI pipeline
• Fun Mode: Creative AI image transformations into artistic styles
• Photo Booth: AI-generated themed photo strips
• Color Analysis: Personal color season analysis using Claude Vision AI

Free watermarked previews are available for most products. Full-resolution outputs require purchase.

3. Eligibility

• You must be at least 13 years of age to use the Service
• If you are under 18, you must have parental or guardian consent
• You must provide accurate information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must not upload photos of minors for AI generation purposes

4. User Responsibilities and Prohibited Conduct

You agree to use the Service lawfully and responsibly. You must not:

• Upload photos of individuals without their explicit consent
• Use the Service to create defamatory, obscene, misleading, or illegal content
• Attempt to impersonate another real person using AI-generated images
• Generate content that could be used for fraud, deception, or identity theft
• Reverse-engineer, scrape, or abuse our API or infrastructure
• Circumvent usage limits, rate limits, or payment requirements
• Use the Service for any purpose unlawful under Australian law or the law of your jurisdiction

We reserve the right to suspend or terminate accounts that violate these rules, with or without prior notice, and without refund where the breach is material.

5. Intellectual Property

Your uploaded photos

You retain full ownership of all photos you upload. By uploading photos, you grant SnapAU.ai a limited, non-exclusive, royalty-free licence to process and temporarily store them solely for the purpose of generating your AI images. This licence ends when your photos are deleted (within 14 days of upload).

Generated images — your ownership

AI-generated images produced from your photos are yours. You may use them for personal and professional purposes including LinkedIn profiles, social media, CVs, and marketing materials.

You may not sell the raw generated images as stock photos, claim they are unaltered photographs of a real person, or use them in ways that would constitute fraud or misrepresentation.

No training on your images

We do not use your uploaded photos or generated images to train, fine-tune, or improve shared or public AI models. Your images are processed exclusively to generate your personal outputs.

Platform intellectual property

The SnapAU.ai brand, website, software, and underlying AI pipeline remain the intellectual property of Wise Choice Australasia Pty Ltd. Nothing in these Terms grants you rights to our platform IP.

6. Payment Terms

• All prices are displayed in Australian Dollars (AUD)
• GST is included in displayed prices for Australian customers where applicable
• Payments are processed securely by Stripe (see Stripe AU Terms)
• Prices may change; existing paid orders are honoured at the price charged
• Founding Member discounts (50% lifetime) are locked at sign-up and applied automatically

7. Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service you also consent to the collection and processing of your facial biometric data as described in the Privacy Policy.

8. Service Availability and Changes

We aim for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue any feature with reasonable notice. For paid services, if we discontinue a product you have paid for, we will issue a pro-rata refund.

9. Disclaimers

• AI-generated image quality and likeness accuracy may vary
• We do not guarantee that generated images will meet any specific quality standard
• We are not responsible for how generated images are used once downloaded by you
• The Service is provided "as is" to the extent permitted by law

10. Limitation of Liability

To the maximum extent permitted by the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010), SnapAU.ai's total liability for any claim arising from your use of the Service is limited to the amount you paid for the specific order giving rise to the claim.

We are not liable for indirect, incidental, special, or consequential damages.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or right conferred by the Australian Consumer Law that cannot legally be excluded.

11. Termination

You may close your account at any time by emailing hello@snapau.com.au. We may suspend or terminate your account if you breach these Terms. Upon termination, your right to use the Service ceases immediately. Clauses relating to IP, payment obligations, limitations of liability, and dispute resolution survive termination.

12. Dispute Resolution

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of NSW. Before commencing legal proceedings, you agree to contact us at hello@snapau.com.au to attempt resolution in good faith.

13. Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify registered users by email at least 14 days before the change takes effect. Continued use after changes constitutes acceptance of the revised Terms.
